7.7.1 Receive court writ or complaint
Agent process
If Agents receive a County Court writ or Magistrates’ Court complaint, they must:
- acknowledge receipt of the complaint or writ
- forward the complaint or writ to WorkSafe, within two days of receipt for WorkSafe to register and allocate to a panel solicitor
Note: Complaints about access to information are forwarded to WorkSafe’s FOI Unit.
- provide a copy of relevant claim file documentation to the panel solicitor or WorkSafe’s FOI Unit in matters relating to access to information
- notify the employer of receipt of the complaint or writ
- act on requests by WorkSafe or the panel solicitor to arrange:
- medical examinations
- investigation
- surveillance
Liaise with panel solicitor
The Agent liaises with the panel solicitor:
- about ongoing management of the claim
- before arranging medical examinations or other investigations
- to provide relevant new information
- to provide instructions in line with peer review outcomes.
WorkSafe
WorkSafe will:
- allocate litigation to the appropriate panel solicitors
- conduct data integrity checks
- conduct peer reviews
- develop guidelines and procedures for managing litigation.
Panel solicitor
The panel solicitor will:
- update the LIMS database for hearings, adjournments and results
- handle litigation management strategies and implements peer review outcomes.
